Y28 INTERNET ACCESS SERVICE
TERMS & CONDITIONS
DEFINITIONS
The following expressions shall, unless the context otherwise requires, have the following meaning:
  "Y28"
Y28.COM LIMITED, the operations agent of KANNET LIMITED, a licensed Internet Service Provider for providing internet access service. Both companies are members of the Champion Technology Group.
 "Services"
Internet access service and/or e-mail service provided by Y28 and/or Kannet Limited.
 "Subscriber" or "Subscriber(s)"
Successful subscriber(s) of the Services (inclusive of subscription under General Service Plan and Fixed Term Service Plan).
 "Policy"
Policy of rendering Services to the Subscriber(s) by Y28 which content as refer to Part I hereof and form an integral part of this Terms and Conditions.
     
PART I    
1.
SUBSCRIBER'S CONSENT TO THE TERMS AND CONDITIONS
 
By using the Services, the Subscriber(s) shall agree to be abided by the Terms and Conditions as set out herein.
 
POLICY
2.
USE OF SERVICES & INVESTIGATION
2.1
The Services are provided for use in conformance with this Policy and the Terms and Conditions. Y28 reserves the right to investigate suspected violations of the Terms and Conditions. When Y28 becomes aware of possible violations, Y28 may initiate investigation which may include gathering information from the Subscriber(s) involved and the complaining party, if any, and examination of materials on Y28's servers.
2.2
During an investigation, Y28 may suspend the subscription(s) involved and remove the materials involved from its servers. If Y28 believes, a violation of the Terms and Conditions has occurred, it may take actions at its sole discretion. This action may include, but not be limited to, temporary or permanent removal of materials from Y28's servers, warnings to the Subscriber(s) involved, and the suspension or termination of the subscription involved. Y28, at its discretion, will determine what action will be taken in response to a violation on a case-by-case basis. Violations of the Terms and Conditions could also subject the Subscriber(s) to criminal and civil liability.
 
3.
USE OF MATERIALS
3.1
Materials in the public domain (e.g., images, text, and programs) may be downloaded or uploaded using the Services. The Subscriber(s) assumes all risks regarding the determination of whether material is in the public domain. Y28 shall not be responsible for the Subscriber's actions.
3.2
The Subscriber(s) is prohibited from storing, distributing or transmitting any unlawful material through the Services. The Subscriber(s) may not post, upload or otherwise distribute copyrighted, trademarked and other proprietary material on Y28's servers without proper authorization. The storage, distribution, or transmission of unlawful materials will subject the Subscriber(s) to criminal as well as civil liability.
3.3
The Subscriber(s) may not store, distribute or transmit other undesirable, unlawful or prohibited materials on Y28's servers.
 
4.
PASSWORDS
 
The Services are for individual use only. The Subscriber(s) is prohibited from sharing password(s) or account(s) with other individuals.
 
5.
SYSTEM SECURITY
5.1
The Subscriber(s) is prohibited from compromising the security or tampering with Y28's system resources or accounts on any our computers, routers, terminal servers, modems, or any other equipment at our or at any other site. Use or distribution of tools designed for compromising security is prohibited.
5.2
Y28 reserves the right to release the e-mail address of Subscriber(s) involved in violation of system security and personal details, in order to resolve security incidents. Y28 will also cooperate fully with law enforcement authorizes in investigating suspected lawbreakers.
   
6.
SYSTEM RESOURCES
6.1
Y28 will allocate system resources to provide all Subscribers with the best service possible. As part of resource allocation, Y28 may limit, restrict or prioritize access to system resources.
6.2
Y28 may log instances of abuse of system resources, including those outlined below, and take action as outlined in Section 2.2 above.
6.3
System abuse is defined as any use of Y28 resources which disrupts the normal use of Y28 system or Services for others. Examples of system abuse include attempting to disrupt the sessions of other Internet users, consuming excessive amounts of time, memory or disk space bandwidth or otherwise affecting the performance of Y28 servers or network.
 
7.
ACCEPTABLE USAGE
 
Acceptable usage is defined as the normal activities associated with the usage of the Internet, usage of Y28's systems and network facilities for accessing the WWW, IRC, Usenet News, e-Mail, and other Internet features.
 
8.
PROHIBITED ACTIVITIES
 
Activities prohibited by Y28 administration include all commonly unacceptable activities on the Internet.
 
9.
PENALTIES FOR ABUSE
9.1
All abusers are subject to immediate termination of their accounts. Y28 reserves the right to recover all damages as the result of the abuse. Information of the abusers will also be disclosed to appropriate authorities.
9.2
The Subscriber(s) agree to indemnify and hold Y28, its officers, directors, shareholders, employees, agents, subsidiaries, and affiliates harmless from any and all claims and expenses related to the Subscriber's violation of the Terms and Conditions, including any abusive or unlawful behavior on the part of the Subscriber(s) or the Subscriber's dependents, or the infringement of any intellectual property or privacy right of any person or entity.
 
PART II 
SERVICES
1.
Y28 will provide the Subscriber(s) with a login ID and password to access our Services.
2.
The Subscriber(s) must comply with the Terms and Conditions and will be responsible for Subscriber's use of our Services.
 
SUBSCRIBER'S COVENANTS
3.
Subscriber(s) will abide by all relevant laws and the Terms and Conditions relating to the use of our Services.
4.
Services must not be used in any way which may breach any confidence, copyright, intellectual property or other rights of us or any third party nor for any commercial, illegal, improper, immoral, defamatory, unsolicited advertising, or promotion purpose.
5.
Subscriber(s) will not copy, distribute, publish, transmit or otherwise exploit any Content accessed through our Services unless Subscriber(s) own or control such Content. Content means any content, software, data, information, diagram, symbol or other material in whatever languages or forms (including all textual, audio, video, graphical, musical, still and moving images)(the "Content"). Subscriber(s) will not reverse engineer any Content or transmit any data that may cause damage to the computer equipment of any persons including uploading a program with a computer virus or any harmful software application.
6.
Subscriber(s) will not use or allow others to use the Services to publish, distribute, transmit or circulate any unsolicited advertising or promotional materials or any content which is obscene, indecent, seditious, offensive, defamatory, threatening, liable to incite hatred, discriminating, menacing objectionable or for mail-spamming junk mail and/or bulk transmission of messages to Internet users, service providers or newsgroup.
7.
Subscriber(s) will not, and will not allow others to copy, sub-license, distribute, sell, transfer, rent, exploit, alter, decompile, disassemble, tamper with, misuse, reverse engineer or repair any software, equipment, facilities and programs Y28 supply to Subscriber(s).
8.
Without Y28's authorization, Subscriber(s) will not, and will not allow others, to hack into, use or access (or attempt to do any of the above) any part of the Services and the Content on Y28's server(s).
9.
Subscriber(s) will not part with, transfer nor sub-license any of Subscriber's rights to use the Services. Subscriber(s) will keep Subscriber's login ID and password secret at all times.
10.
Subscriber(s) acknowledge that Y28's affiliates, agents or contractors may provide any part of our Services or perform any of Y28's duties.
11.
Y28 may change or withdraw any of our Services or any Content at any time. We may also suspend our Services at any time without notice to carry out maintenance or other works to our system.
 
PROVISION OF SERVICES & EXCLUSION OF LIABILITY
12.
Y28 Services are supplied on an "as is" basis. All conditions, warranties and responsibility in relation to the provision of Y28 Services (including title, fitness for any particular purpose, merchantability, content, quality and accuracy) are excluded to the extend permitted by law. Use of our Services or any information obtained via Y28 Services is at Subscriber's own risk.
13.
Y28, its officers, directors, shareholders, employees, agents, subsidiaries, and affiliates will not be liable to Subscriber(s) whether in contract, tort, statute or otherwise for any direct or indirect loss or damage which is suffered or incurred by Subscriber(s) arising out of the use of Services or in any other vary out of the Terms and Conditions.
14.
Subscriber's privacy will be respected. Y28 will not monitor the contents of Subscriber's private communications unless required to do so by law or we believe that it is necessary to protect ourselves or other persons from injury or damage.
 
INDEMNITY
15.
Subscriber(s) will indemnify and hold Y28, its officers, directors, shareholders, employees, agents, subsidiaries, and affiliates harmless from all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable attorneys fees) relation to any acts by Subscriber(s) or materials or information transmitted by Subscriber(s) in connection with Y28 system leading wholly or partially to claims against Y28 or third parties.
 
PAYMENT OF FEES
16.
Y28 or its designated, will send Subscriber(s) regularly e-statement showing the payments due. A hard copy of this statement will be available by mail upon request at a handling charge. Any dispute over the statement must be raised within 14 days from the date of the statement.
17.
The fees for Y28 Services other than PNETS charge must be paid in advance. Y28 may charge interest at 2% per month on any outstanding fees. Pre-paid charges are non-refundable unless Y28 decides otherwise.
18.
Prepayment made by Subscriber(s) is not risk free and in the unlikely event that Y28 go into liquidation, there is no guarantee that Subscriber(s) will receive the prepayment back. In the unlikely event of liquidation, Subscriber's rights to get refund of the prepayment will be subject to the relevant laws and regulations governing liquidation of companies in Hong Kong.
19.
Any fees Y28 charged will be in accordance with our published fee schedule. Y28 may vary the rates charged to Subscriber(s) at any time. Y28 will inform Subscriber(s) of any change at least one month in advance.
20.
PNETS charge will be currently charged and modified accordingly from time to time when the Office of the Telecommunications Authority announces any changes.
21.
PNETS charge will be payable monthly in arrears and will be published and notified Subscriber(s) through regular e-statement. 
 
CONFIDENTIALITY
22.
Subscriber(s) allows Y28 to collect his/her personal data in order to provide Subscriber(s) with our Services. Y28 also use Subscriber's personal data for credit checking, debt collection, marketing, research and promotion of Services.
23.
Y28 will keep Subscriber's personal data confidential. Y28 may provide it to third parties employed by Y28 for the purpose of providing the Services. This may include any of the following services: on site services, maintenance, billing, credit checking, debt collection, and market research. Third parties to whom Subscriber's personal data are provided can use the data only for the limited purpose for which it is provided.
24.
Y28 may provide Subscriber(s) with information about Y28 Services as well as products and services provided by other companies. If Subscriber(s) do not want to receive this type of information shall write to our Personal Data Officer.
25.
Subscriber(s) is entitled to know what personal data Y28 may have about Subscriber(s) and to correct any errors. To access or correct any data please write to our Personal Data Officer, we may impose a modest charge for complying with a data access request.
26.
A copy of Y28 policy on personal data is available by writing to our Personal Data Officer.
 
OTHERS
27.
Y28 may suspend or terminate the Services if Subscriber(s) breach any of the Terms and Conditions including non-payment of any fees due. Y28 may at our sole discretion reactivate our Services to Subscriber(s) if Subscriber(s) has remedied the breach and paid to Y28 any security deposit we may require.
28.
Y28 will assume Subscriber(s) acceptance of the Terms and Conditions by continuing Subscriber's subscription.
29.
Y28 reserves the right to vary, delete or amend any part of the Terms and Conditions herein contained at any time, for such purpose the posting of the amendments and/or deletion on the web-site of Y28 shall suffice as written notice.
30.
Subscriber(s) may cancel his/her subscription at any time after one month of his/her subscription by giving at least one month's notice. Y28 however will not make any refund of any fees if Subscriber(s) cancel Subscriber's subscription.
31.
The Terms and Conditions are governed by the laws of Hong Kong Special Administrative Region and the parties agree to submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
32.
The English version of the Terms and Conditions shall prevail wherever there is a discrepancy between the English version and the Chinese version.

"Y28"
Y28.COM LIMITED，看通網絡有限公司之營運代理，而看通網絡有限公司則為一持牌互聯網服務供應商。兩間公司均為冠軍科技集團之成員。
服務
即Y28及／或看通網絡有限公司提供的互聯網接駁及／或電郵服務。
客戶
已申請成為本公司服務（包括選用「一般服務計劃」及「固定期服務計劃」）的客戶。
政策
指Y28提供服務予客戶的政策，並為本條款及細則的一部分，其內容請參閱本文第一部分。
   
第一部分  
1.
客戶同意條款及細則
 
客戶選用此服務時，即同意遵守此條款及細則。
 
政策 
2.
服務使用及調查
2.1
Y28之服務是根據此政策和條款及細則提供。Y28有權就任何懷疑違反本條款及細則的情況進行調查。當Y28知悉有任何可能違反的情況出現時，Y28或會啟動調查程序，包括向有關客戶和投訴人（如有）搜集資料和查驗Y28伺服器上的材料。
2.2
於調查期間，Y28有可能暫停提供有關服務及從伺服器上移除有關材料。假若Y28相信有違反本條款及細則的情況發生，Y28有權因應個別個案之實際情況採取適當行動。該等行動包括但不限於暫時或永久地從Y28伺服器上移除有關材料，向有關客戶發出警告，以及停止或終止有關服務。如客戶違反本條款及細則，客戶可能須負上刑事及民事責任。
 
3.
材料使用
3.1
任何屬於公有領域之材料均有可能經由Y28服務上傳或下載（例如：圖像、文字及程式等），唯客戶需承擔所有因判斷有關材料是否屬於公有領域之材料所造成的風險，而Y28將不會對客戶該等行為負上任何責任。
3.2
客戶不可利用此服務用作儲存、分發、或傳送任何非法或被禁的材料，亦不可利用Y28伺服器發放或上傳未經正式授權下使用具有版權的、註冊商標的或其他專利的材料。客戶並可能因參與上述該等活動而須負上刑事及民事責任。
3.3
客戶不可利用Y28伺服器儲存、分發、或傳送任何令人反感、非法或被禁的材料。
 
4.
密碼
 
此服務只提供予客戶個人使用，客戶不得與其他人分享密碼與帳戶。
 
5.
系統保安
5.1
客戶不可危害Y28的系統保安或損害我們的系統資源，和損害在任何電腦、路由器、終端伺服器、數據機或我們的或位於任何位置的裝置上的帳戶。客戶亦不可使用或分發可危害保安的工具。
5.2
如客戶違反網站的保安系統，Y28有權向有關方面透露客戶的電郵地址及個人資料，以協助其處理有關的保安事宜。Y28並會與執法機關全面合作以調查有關的懷疑違法行為。
   
6.
系統資源
6.1
Y28保留權利管理Y28的系統資源以為所有客戶帶來最大的利益。Y28可能對連接到系統資源的客戶作出限制、約束或優先處理。
6.2
Y28可能就系統資源被濫用以及下列所述的情況作出紀錄，並根據上述條款第2.2條採取行動。
6.3
系統濫用指任何使用Y28的資源而影響到其他客戶正常使用Y28系統或服務的行為，包括嘗試中斷其他互聯網用戶的連線、佔用過量的中央處理器時間、記憶體、磁碟空間及頻寬等，或對Y28伺服器或網絡造成影響的行為。
 
7.
可接受使用量
 
可接受使用量指利用Y28的系統和網絡設施進行正常的互聯網活動，例如連接萬維網、即時聊天室、新聞群組、電子郵件及其它互聯網服務。
 
8.
嚴禁行為
 
Y28所禁止的活動包括一切在互聯網上一般所不能接受的活動。
 
9.
違反之罰則
9.1
所有違反者將立即被終止其帳戶。Y28保留權利追討有關之違反行為所導致之一切損失，並向有關機構披露違反者的個人資料。
9.2
客戶如違反本條款及細則，包括客戶或客戶的家屬的任何違反性或非法的行為，或侵犯任何人或實體的知識產權或私隱權，客戶同意保障Y28、其職員、董事、股東、僱員、代理、附屬公司及聯營機構以免蒙受就該等行為所引致的損害以及任何和所有申索及開支，並予以賠償。
 
第二部分 
服務
1.
Y28會向客戶提供一個登入帳號及密碼以供使用我們的服務。
2.
客戶必須遵守本條款及細則及必須為客戶本人或任何指定的使用人士所使用的服務負責。
 
客戶的契約
3.
客戶於使用服務時，必須遵守所有適用法律和此條款及細則。
4.
客戶於使用服務時不可侵犯我們、任何第三者或任何商業機構的機密、版權、知識產權或其他權利，亦不可利用我們的服務進行任何商業行為、非法的、不恰當的、不道德的、誹謗性的用途，或未經收件人許可的廣告或宣傳活動。
5.
除非你擁有該等內容，否則客戶不得複製、分發、發佈、傳送或以其他方式利用我們的服務所取得的內容。內容意指不論以任何語言或形式之任何文字內容、軟件、數據、資料、圖表、符號或其他材料，包括文字、影像、圖表、音樂、動態及靜態圖像（「內容」）。客戶亦不可逆工程化任何內容或傳送任何可損害其他電腦裝置的資料，包括上傳帶有電腦病毒的電腦程式或任何損害性軟件。
6.
客戶不可及不可容許其他人使用該服務出版，分發，傳送或傳播任何未經同意或內容涉及淫穢、猥褻、煽動性、攻擊性、誹謗性、威脅性、煽動仇恨、歧視等的內容、廣告或宣傳材料，或濫發垃圾郵件和／或大批傳送訊息至其他互聯網用戶、服務提供者或新聞群組。
7.
客戶不可及不可容許其他人複製、分銷、分發、出售、轉授、出租、非法私用、更改、反編譯、反裝配、干預、濫用、逆工程化或維修Y28所提供的任何軟件、裝置、設備及電腦程式。
8.
未經Y28授權，客戶不可亦不可容許他人入侵、使用或連接到Y28的伺服器內的任何服務及內容，或試圖作出以上其中一種行為。
9.
客戶亦不可將本身享用此服務的權利與他人分享、轉授或分銷予他人。客戶亦必須經常妥善保管你的登入帳號和密碼。
10.
客戶知悉Y28可委託代理或承包商向客戶提供全部或部分服務或履行任何Y28的職責。
11.
Y28可隨時更改或取消我們提供的任何服務或內容。我們亦可在未有事先通知下隨時暫停我們的服務以進行保養或其他系統或網絡工程。
 
服務提供及免責條款
12.
Y28以「現況」的基礎下提供服務。在法律容許的情況下，Y28對我們提供的服務（包括其所有權、對某特定用途的適用性、可商售品質、內容、品質、不侵犯他人權利及準確性）不作出任何承諾、保證或負上任何責任。客戶同意承擔使用Y28服務或透過我們的服務所獲得的任何資料所帶來的所有風險。
13.
Y28、其職員、董事、股東、僱員、代理、附屬公司及聯營機構不會因客戶使用我們的服務或因本條款及細則下而引致的任何直接或間接的損失或損害承擔任何責任，不論合約、民事過失或法律條款有規定亦然。
14.
Y28對客戶的私隱十分尊重。除法例所需或因我們相信需要保障我們或其他人免受傷害或損害的情況外，Y28是不會監控客戶的私人通訊內容。
 
賠償
15.
客戶同意保障Y28、其職員、董事、股東、僱員、代理、附屬公司及聯營機構免受因客戶經由Y28系統所作的任何行為，或發放材料或資料等，而引致Y28或第三者蒙受的全部或部分索賠、訴訟、損害、傷害、責任、損失、費用和開支 (包括合理的律師費用)，並予以賠償。
 
收費
16.
Y28或其指派者會定期以電子郵件方式向客戶發送帳單，並列出其應繳金額。 如客戶要求及同意繳付手續費用，我們可以郵寄帳單副本予客戶。所有對帳項的爭議必須在帳單日期起計十四天內提出。
17.
除PNETS 費用外，Y28服務費用均需預繳。Y28有權對任何過期未繳的費用徵收每月百分之二的利息。除Y28另外訂明，否則所有預繳費用將不會退回。
18.
客戶的預繳費用並非毫無風險，如於相當不可能的情況下，Y28需要清盤時，不能保證客戶可取回其所預繳的費用，而該取回的預繳費用的權利將受到香港公司清盤法例和規例管限。
19.
Y28將根據我們公佈的收費標準收費。Y28可隨時更改對客戶收取的費用。關於收費的更改，Y28將給予客戶不少於一個月的預先通知。
20.
PNETS收費均按香港電訊管理局不時公佈之最新收費收取及調整。
21.  
PNETS收費將按下期每月繳付，並將定期透過電子郵件通知客戶。
 
機密
22.
客戶同意Y28收集你的個人資料以向你提供我們的服務。Y28亦將客戶的個人資料用作信用覆查、追收債務、市場推廣、市場研究及服務推廣的用途。
23.
Y28會將客戶的個人資料保密，亦可能使用或向受僱於Y28的第三者提供客戶的個人資料以便提供服務，包括以下任何一種服務：上門維修服務、保養、帳單服務、信用覆查、追收債務及市場研究。第三者僅限於使用客戶個人資料作有限度用途。
24.
Y28可向客戶提供有關其本身或其他公司的產品及服務資料。如客戶不欲收取此等資料，請以書面通知我們的資料私隱主任。
25.
客戶有權要求查閱或更改在Y28儲存的個人資料。如有需要，請以書面通知我們的資料私隱主任，唯我們有可能對有關查閱的要求酌量收費。
26.
有關我們的個人資料政策，可來函向我們的資料私隱主任索取副本。
 
其他 
27.
假如客戶違反了此條款及細則內之任何條款，包括沒有繳交任何應付費用，Y28可能暫停或終止客戶的服務。如客戶已就有關的違約行為作出補救措施，Y28可決定是否恢復對客戶的服務，及繳交Y28可能要求的保證金。
28.
客戶繼續使用Y28的服務即代表客戶同意遵守此條款及細則。
29.
Y28保留權利隨時更改、刪除或修改本條款及細則之任何條款，將有關的修改及／或刪除張貼於Y28的網頁內將視為足夠予客戶的書面通知。
30.
客戶可以隨時終止服務，但必須於服務生效期一個月後，給予我們不少於一個月的通知，唯Y28將不會退還任何已繳交之費用予客戶。
31.
本條款及細則按香港特別行政區之法律詮釋，雙方同意接受香港法院的非專屬司法管轄權管轄。
32.
本條款及細則的英文與中文本之間有任何歧義，應以英文本為準。
